For contracts concluded exclusively by means of distance communication (website, e-mail, telephone) or away from business premises, consumers have the statutory right of withdrawal described below. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. Please note the section „Exclusion of the right of withdrawal”: there is no right of withdrawal for sails and other goods that we manufacture to your measurements and specifications.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day
- on which you or a third party named by you, who is not the carrier, took possession of the goods (in the case of sales contracts);
- on which you or a third party named by you, who is not the carrier, took possession of the last item, if you ordered several goods in a single order that are delivered separately;
- on which you or a third party named by you, who is not the carrier, took possession of the last part-consignment or the last item, if goods are delivered in several part-consignments or items;
- of the conclusion of the contract in the case of contracts for services (e.g. repair, service, storage).

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, although this is not mandatory.
You can also exercise your right of withdrawal online at https://beilken.de/en/withdraw-from-contract/. If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by e-mail) without delay, stating the content of the withdrawal declaration and the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us (Canvas Solutions GmbH, Beilken Sails, Loft Dampfschiffsweg 11, 21079 Hamburg, Germany) without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods. For goods that cannot normally be returned by post due to their nature (freight goods), the costs are estimated at a maximum of approximately 150 euros.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If you requested that the services should begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Exclusion and early expiry of the right of withdrawal
There is no right of withdrawal for contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (section 312g (2) no. 1 BGB).
This applies in particular to all sails, covers and accessories that we manufacture to your measurements, your choice of cloth and equipment, with your sail number, your markings or your logos (custom-made items from the sail configurator, the quote forms and the measurement forms). The exclusion applies from the conclusion of the contract, i.e. from your acceptance of our quote, regardless of whether we have already started production. We point out that there is no right of withdrawal in the quote and on the order page before the contract is concluded. If you no longer want a custom-made item after the contract has been concluded, section 10 of our terms and conditions applies (termination with remuneration of the costs already incurred).
The right of withdrawal does apply to prefabricated stock items, accessories and used sails.
The right of withdrawal expires early in the case of contracts for services (e.g. repair, service, bending on and unbending, storage) if we have provided the service in full and only began performing it after you gave your express consent and at the same time confirmed your awareness that you would lose your right of withdrawal once we had fully performed the contract.
